Kathmandu. The necessary process has been initiated to remove Badri KC from the secretariat of the Non-Resident Nepali Association (NRNA). For that, the Supreme Court's Judgment Implementation Directorate has written to the secretariat for the third time to provide assistance to the high-level committee led by Shesh Ghale.
A year ago, the Supreme Court had given a mandate to Ghale to hold a general convention of unity, but Badri KC had been running the office in a way that captured him, causing many conflicts. The committee is completing the necessary process after he refused to leave the office despite having no legal status to stay in the office. Since Ghale is legally strong, he has completed the process and made final preparations to remove Badri from the office and carry out the necessary work from the secretariat. A member said that even though all the processes have been completed, Ghale will do all the work from the office in a few days. According to the member, Badri must now leave the office and preparations are underway to proceed with all the necessary processes, starting from the defamation case.
Badri has now been claiming to be official by pointing to the second verdict given by the Supreme Court. However, legal experts say that the decision only asked not to implement the foreign ministry's letter, so it does not have any official authority other than Ghale.


Accordingly, the Supreme Court's Judgment Implementation Directorate sent a warning letter to the NRNA secretariat on Tuesday.
The directorate sent a third warning letter on Tuesday after the high-level committee led by Shesh Ghale had previously written to the office to take over the office, but it did not implement it.
The letter states, "Since there is an intention to circumvent the Supreme Court's order of 2080 Chaitra 21, please implement the order of the esteemed Supreme Court again within 5 days and inform this directorate about it."

Otherwise, a warning has been issued through a letter implementing the procedure as per the Supreme Court Rules. The letter states that it is the duty of the secretariat to assist the directorate in the implementation of the judgment, and if there is any obstruction, disruption or failure to comply with the order, a report will be submitted with details of the non-compliance by disobeying the court order.

Earlier on Falgun 11, the same directorate had directed the high-level committee to hand over all the office, staff administration, cash and in-kind goods, documents, and other items for the purpose of holding new elections. The coordinator of the high-level committee is former president Shesh Ghale.

However, the KC-led NRNA had sent a letter to the Decision Implementation Directorate clarifying that the office could not be handed over. Instead, the letter asked Ghale about the legal basis for handing over the office. ‘The legal basis for the secretariat, which has been fulfilling its responsibilities under the working committee as per the association’s statute, to hand over has not been mentioned in the directorate’s directive,’ the letter said.

‘There has been no order from the esteemed Supreme Court that would seriously affect the continuity of the association. It is completely unfair and illegal to hand over sensitive documents of the association without reason and legal provisions, contrary to the prevailing law and the association’s statute,’ the reply letter said.

On Chaitra 21 last year, the Supreme Court had given a mandate to hold a general convention of unity in the NRNA dispute. Following that mandate, the Ministry of Foreign Affairs had banned the leadership of Badri KC, who was elected from the 11th general convention, from working. After KC went to court against this, the Supreme Court ordered not to implement the letter of foreign affairs, and he has been working from the secretariat again.
KC has been claiming that Ghale cannot hold the Ekta General Convention without his cooperation since he returned to work. After KC refused to vacate the office citing the second verdict, the Supreme Court sent a second letter to the NRNA Secretariat with a 5-day ultimatum.
NRNA High-Level Committee member Binod Kunwar said that the KC side has no option but to hand over the office as per the Supreme Court's letter. Otherwise, he said that they will now proceed with the defamation process. Ghale has moved forward with the process to hold the Ekta General Convention in May, but Badri, who came to the leadership from the 11th General Convention, has said that he is the official and has said that the general convention will be held in October. As the debate continues in the NRNA whether the general convention will be held in May or October, some members of the high-level committee are also divided.
Before the two letters were sent to Ghale to hand over the office, the Directorate had also sent a letter on November 11. In which, Ghale was requested not to obstruct anything, seeking information about the closure of the Non-Resident Nepali Association secretariat. Since that letter was also related to the implementation of the decision, the Directorate has sent a third letter, including on Tuesday.
